Are Court Records Public in Allen County?
Ohio’s public records framework is established under Ohio Revised Code Section 149.43, commonly referred to as the Ohio Public Records Act. Under this statute, records maintained by any public office — including county courts — are generally considered public records that must be made available for inspection and copying upon request.
Allen County court records fall within this framework, and most filings, docket entries, judgments, and orders are accessible to the public. The Ohio Attorney General’s office oversees compliance with public records obligations and provides guidance on the law’s application.
However, several categories of court records are restricted from general public access:
- Sealed records — A court may seal case records upon motion and for good cause, making them inaccessible to the public
- Expunged records — Criminal records that have been expunged under Ohio law are treated as if they do not exist for purposes of public access
- Juvenile records — Proceedings in the Juvenile Division of the Court of Common Pleas are generally confidential
- Medical records — Health-related documents submitted in court proceedings may be exempt from disclosure
- Trade secrets — Business records designated as trade secrets by a court are protected from public release
- Adoption records — These are confidential under Ohio law, with limited exceptions
Requesters do not need to identify themselves or state a reason for seeking public records under Ohio law. However, certain restricted records may require proof of identity or a demonstrated legal right of access before copies will be released.
