How to Look Up a Court Case in Erie County?

Locating a court case in Erie County depends on which court handled the matter. The county operates several courts at different locations, and each maintains its own records system.

Online Search Options

The Clerk of Courts operates the Public Information Case (PIC) System, which allows the public to search civil, criminal, and domestic relations case records from the Court of Common Pleas. Searches can be conducted by party name, case number, case type, filing date, or date of birth. Note that case images from 2000 through 2009 may have gaps, and no imaging exists from 2009 through February 2013. Domestic relations case images are not available through the PIC System.

For Erie County Municipal Court cases, the online record search and payment portal allows searches by name, ticket number, or case number. The Vermilion Municipal Court record search provides a similar tool, and the Sandusky Municipal Court record search covers cases in its jurisdiction.

The Erie County Probate Court maintains its own record search on its website, covering estates, guardianships, adoptions, and other probate matters.

In-Person Requests

The Clerk of Courts office at 323 Columbus Avenue, First Floor, is open Monday through Friday, 8:00 a.m. to 4:00 p.m. Visitors can request case file reviews by providing a case number or party name. Court costs for Common Pleas cases can also be paid online.

Are Court Records Public in Erie County?

Ohio has a strong tradition of open government records. Under Section 149.43 of the Ohio Revised Code, “public record” is defined broadly to include records maintained by any public office, including courts. This statute requires that public records be made available for inspection and copying within a reasonable time. Rule 45 of the Rules of Superintendence for the Courts of Ohio reinforces this principle by establishing a presumption of public access to court records and directing clerks to make records available both directly and remotely.

Not all court documents are available for public viewing, however. The Ohio Revised Code and the Rules of Superintendence exempt several categories of records from public access:

  • Medical records filed as part of court proceedings
  • Trial preparation records
  • Confidential law enforcement investigatory records
  • Adoption records, which are sealed upon finalization
  • Mental health commitment records
  • Records related to Adult Protective Services
  • Probation and parole proceedings documents
  • Specific juvenile records governed by confidentiality rules
  • Records sealed by court order or through the expungement process
  • Information that, if released, would infringe on an individual’s privacy rights or would not serve the public interest

Rule 44 of the Rules of Superintendence provides additional guidance on what constitutes a court record, including administrative documents. Anyone seeking records should be aware that the PIC System specifically excludes domestic relations case images, and certain sensitive case types may be restricted at the clerk’s discretion or by judicial order.

Erie County Criminal Court Records

Criminal cases in Erie County are divided among several courts depending on the severity of the charge. Felonies are prosecuted in the General Division of the Court of Common Pleas, while misdemeanors fall under the jurisdiction of the municipal courts and the County Court at Law. Traffic infractions are handled at the municipal court level.

Statewide Criminal Background Checks

The Bureau of Criminal Investigation (BCI), overseen by the Ohio Attorney General, processes fingerprint-based criminal background checks. Access requires the subject’s consent through fingerprints collected at a licensed agency. Erie County Civil Court Records

Additional execution-related fees include $150.00 for debtor exams and $100.00 for personal earnings garnishment or bank attachment. Certificate of judgment filing costs $31.00, with $6.00 for issuing and $6.00 for releasing.

Municipal Court Civil Costs

At the Erie County Municipal Court, civil filing costs are $100.00, small claims cost $75.00 (plus $10.00 per additional defendant), and forcible entry and detainer costs $208.00 (plus $10.00 per additional defendant).

Erie County Family Court Records

Family-related matters in Erie County are distributed across the Domestic Relations Division and the Juvenile Division of the Court of Common Pleas. The Domestic Relations Division handles divorces, dissolutions, legal separations, annulments, and civil protection orders. The Juvenile Division adjudicates delinquency cases, abuse and neglect proceedings, paternity, custody, and child support matters.

Domestic Relations Records

The Clerk of Courts’ Domestic Relations Division maintains all family case files. Due to the sensitive nature of these proceedings, document images are not available through the PIC System. Juvenile Court

The Juvenile Court operates from three locations:

Juvenile case records are generally confidential under Ohio law, though certain records may be inspected by contacting the Juvenile Division and providing the child’s name.

Marriage Licenses and Vital Records

Marriage licenses in Erie County are issued by the Probate Court. The license fee is $43.00, and certified copies of marriage records cost $2.00 each. Requests for certified copies can be submitted by completing a Marriage License Certified Copy Request Form and mailing it with payment (cash or check payable to Erie County Probate Court) and a self-addressed stamped envelope to the Probate Court at 323 Columbus Ave., 2nd Floor, Sandusky, OH 44870. Processing takes up to two weeks.

Birth and death certificates are issued by the Erie County Health Department, which provides same-day service for in-person requests:

Certified copies cost $25.00 each, payable by cash, money order, credit card, or certified bank check. Requests can also be placed by phone at (419) 626-5623 ext. 5122 or by mailing the completed Vitals Application for Certified Copies. Records are available from December 1908 to the present. Under ORC 3705.23(5), a decedent’s Social Security number is withheld from death certificates for five years after death unless specifically requested by a qualified party with acceptable proof of relationship.

Erie County Probate Court Records

The Probate Division of the Erie County Court of Common Pleas handles the administration of estates, guardianships, conservatorships, adoptions, name changes, marriage licenses, mental health commitments, and over two hundred other statutory duties assigned by the Ohio Revised Code. All probate forms are available on the Probate Court’s website and must be typed — the court does not accept handwritten documents. Estate records, guardianship files, and trust proceedings are generally public. However, adoption records and mental health commitment records are sealed and excluded from public inspection. Deposits paid at filing are maintained until the case closes, at which point unused funds are refunded, and no case is closed until all costs have been satisfied.
