Are Court Records Public in Greene County?
Ohio’s Public Records Act (Ohio Revised Code § 149.43) establishes that records maintained by public offices, including courts, are open to public inspection and copying. Records Exempt from Public Disclosure
Several categories of court records are excluded from public access under ORC § 149.43 and other statutes:
- Adoption proceedings and records
- Records specifically prohibited from release by state or federal law
- Trial preparation records (attorney work product, litigation strategy documents)
- Juvenile court records in certain circumstances
- Grand jury proceedings
- Records sealed by court order
In addition, ORC § 149.45 requires the redaction of personal identifiers from court records before they are made public. Under Ohio Rule of Superintendence 45, parties filing documents are responsible for omitting Social Security numbers, state or federal tax identification numbers, and other sensitive personal data. Pursuant to ORC § 2303.901(B), the Clerk of Courts is not liable if a party includes unredacted personal identifiers in a filing that the clerk subsequently posts online.
Greene County Criminal Court Records
Criminal jurisdiction in Greene County is divided among three court levels. The Court of Common Pleas, General Division, has original jurisdiction over all felony cases arising in the county. The Xenia Municipal Court handles misdemeanor and traffic offenses committed within 17 communities, including the city of Xenia. The Fairborn Municipal Court has jurisdiction over misdemeanor and traffic violations occurring in Fairborn, Bath Township, Beavercreek, and Beavercreek Township.

Greene County Civil Court Records
Civil cases in Greene County are heard by the Court of Common Pleas (General Division) for claims exceeding $500, and by the two municipal courts for claims up to $15,000. Small claims actions and forcible entry and detainer (eviction) cases also fall within municipal court jurisdiction.
Court of Common Pleas — Civil
The General Division handles contract disputes, personal injury, foreclosures, and other civil matters above the $500 threshold. The Clerk of Courts maintains all filings, and civil case dockets are searchable online through Courtview. Note that records prior to 1982 are not available through the online portal and must be requested in person.
Copy fees at the Clerk of Courts are $0.05 per page for plain photocopies and $1.00 per page for certified copies. Filing fees for civil complaints, foreclosures, and other actions are established by deposit schedule and vary by case type. The current deposit schedule is available from the Clerk of Courts office.
Municipal Court Civil Cases
Civil actions under $15,000 that arise within Xenia Municipal Court or Fairborn Municipal Court jurisdiction are filed with the respective court’s clerk. Records can be searched through the Xenia Municipal Court Public Access portal or the Fairborn Municipal Court search tool. Copy fees and filing costs should be confirmed directly with each municipal court clerk.
Property Records
Property-related records that may be relevant to civil litigation are maintained by two county offices. The Greene County Auditor maintains property appraisals and tax assessment data, accessible online through the Auditor’s Property Search portal. Greene County Family Court Records
Family law matters in Greene County are adjudicated by the Domestic Relations Court, which operates as a division of the Court of Common Pleas. This court has exclusive jurisdiction over divorce, dissolution of marriage, legal separation, child custody, child support, spousal support, and civil protection orders. Marriage Records
Marriage licenses in Greene County are issued by the Probate Court. Effective March 1, 2025, the marriage license fee is $50.00. Payment can be made by cash, credit card, debit card, cashier’s check, or money order. Both applicants must appear in person with valid identification. The Probate Court also maintains marriage records for licenses recorded after October 17, 1991. These records can be searched through the marriage search portal by applicant name or marriage date.
Certified copies of marriage records cost $2.00 each. Active duty and retired military personnel are exempt from this fee with proof such as a military ID. Copies can be requested in person, by mail using the Certified Marriage Record Request Form, or online. Birth and Death Records
Birth and death certificates are maintained by the Greene County Public Health Vital Statistics Office, not the courts. The fee is $24.00 per certified copy. Records are available for births and deaths that occurred in Greene County from 1909 to the present. In-person, mail, and online request options are available. Public probate case records can be searched online through the Probate Court eAccess portal, which covers estate cases, guardianships, conservatorships, trusts, and civil matters. Confidential proceedings such as adoptions are excluded from the online portal. In-person inspection of public probate files is available during regular business hours. Miscellaneous fees include $1.00 per certified copy, $3.00 per authenticated copy (plus $0.10 per page), $5.00 for filing a bond, and $33.00 for filing a will for safekeeping. Adoption assessor fees are $750.00 for stepparent and private adoptions and $1,500.00 for private adoptions with placement.
