How to Look Up a Court Case in Guernsey County?

The primary gateway for Guernsey County court records is the Guernsey County Clerk of Courts, currently held by Jennifer Johnson. The Clerk’s office maintains all legal records filed in the Common Pleas Court – General Division, which covers civil, criminal, and domestic relations matters, as well as records from the Fifth District Court of Appeals.

The Clerk’s office offers three main methods for accessing records:

  • Online: The CourtView public record search portal allows users to search Common Pleas Court cases by name, case number, or case type without visiting the courthouse.
  • In Person: Visitors may come to the Legal Office during regular hours. Bringing a valid photo ID and any known case details — such as party names or a case number — will speed up the search process.
  • By Mail or Email: The Clerk has created both a General Public Record Request Form and a Title Searcher Public Record Request Form. Completed forms can be emailed to clerkrequests@guernseycounty.org. The Clerk may request additional identifying information to expedite processing, but requestors are not legally required to state their identity or their reason for the request under ORC §149.43.

For misdemeanor and traffic cases handled by Cambridge Municipal Court, a separate CaseLook online search system is available. Probate and juvenile court records require direct contact with their respective divisions, as the Clerk of Courts General Division does not maintain those files.

Are Court Records Public in Guernsey County?

Ohio’s Public Records Act under ORC §149.43 establishes the general presumption that court records are open to public inspection and copying. Guernsey County courts operate under this framework, making most case filings, docket entries, judgments, and orders available to any person upon request.

However, the Ohio Supreme Court’s Rules of Superintendence — particularly Rules 44 through 47 — identify specific categories of information that are withheld from public access in order to protect individual privacy rights. The following types of records or data points are not considered public in Guernsey County:

  • Social security numbers (except the last four digits), financial account numbers, driver’s license numbers, and employer or employee identification numbers
  • Documents or case files sealed by court order, or records subject to expungement
  • Juvenile abuse, neglect, and dependency case files, including the juvenile’s name (except initials)
  • Health care documents, including physical, psychological, mental health, and counseling records
  • Drug and alcohol assessments and pre-disposition reports
  • Guardian ad litem reports and home investigation reports
  • Child custody evaluations, domestic violence risk assessments, and supervised parenting time records
  • Financial disclosure statements, asset appraisals, and certain tax documents filed in domestic cases
  • Notes, drafts, and internal research materials of judicial officers and court staff
  • Records protected by state, federal, or common law exemptions

Effective July 1, 2009, Superintendence Rule 45 requires parties filing case documents to omit personal identifiers from those filings. The court and Clerk of Courts are not required to review submitted documents for personal identifiers and cannot refuse to accept a filing solely because identifiers are present. Any person seeking access to a restricted or redacted document may file a written motion with the court.

Records that are ordinarily restricted may be accessed by parties to a case or their attorneys of record, upon presentation of appropriate identification, unless the records have been sealed or expunged.

Guernsey County Criminal Court Records

The Criminal Division of the Guernsey County Clerk of Courts manages all records in felony cases prosecuted in the Common Pleas Court. Felony prosecutions begin either through an indictment issued by the Guernsey County Grand Jury or a Bill of Information filed by the county prosecuting attorney. When a suspect is arrested on a felony complaint, initial proceedings — including bond hearings and preliminary hearings — take place in Cambridge Municipal Court before the case is bound over to Common Pleas Court.

The Criminal Division is responsible for processing all motions, pleadings, and judgment entries in felony matters, maintaining the docket, issuing writs and warrants, processing bonds, issuing subpoenas, reporting final dispositions to BCI&I, and handling court cost and fine collection. Felony criminal records are searchable through the Clerk of Courts public record portal.

The Criminal Division accepts bond payments Monday through Friday, 8:30 AM to 3:30 PM, excluding legal holidays. Personal checks are not accepted for bonds. Types of bonds accepted by the court include cash bonds, ten-percent bonds, own recognizance (OR) bonds, surety bonds, and property bonds. Property bonds require the property to be located within Guernsey County, have a value at least twice the bond amount above existing liens, and require all owners to be present with the property deed and most recent tax statement.

For statewide criminal history background checks, the Ohio Bureau of Criminal Investigation (BCI) maintains Ohio’s central criminal fingerprint database. BCI background checks require submitting a full set of fingerprints, the subject’s full name, age, and address, and a signed consent form where applicable. The Guernsey County Sheriff’s Office offers electronic fingerprinting services for BCI background checks. Fee schedules vary by check type (BCI only: approximately $30; FBI only: approximately $35; combined BCI and FBI: approximately $65). Guernsey County Civil Court Records

Civil case records filed in Guernsey County Common Pleas Court are maintained by the Clerk of Courts Legal Division. The General Division hears a wide range of civil matters, including contract disputes, property disputes, tort claims, and appeals from lower courts. The public record search portal allows online searches of civil case dockets by party name, case number, or case type.

Cambridge Municipal Court also accepts e-filings through efile.henschen.com and accepts filings by U.S. mail, private carrier, fax, or email. In-person filings are accepted during normal business hours.

To request civil records from the Common Pleas Court by mail, requestors should use the Clerk’s Public Records Request Form and email the completed form to clerkrequests@guernseycounty.org. Guernsey County Family Court Records

Family law matters in Guernsey County are divided between two divisions of the Court of Common Pleas. Divorce, legal separation, and dissolution of marriage proceedings are handled by the Domestic Relations Division of the Clerk of Courts, while matters involving minors — including custody, abuse, neglect, delinquency, and unruly child proceedings — fall under the jurisdiction of the Juvenile Court.

The Domestic Relations Division maintains records of divorce decrees, dissolution of marriage orders, property settlements, spousal support orders, and related filings. Divorce records typically include case numbers, party names, and filing dates. Access is available in person, via the CourtView online search, or by submitting a written request. Certain documents within domestic relations files — including financial disclosure statements, child custody evaluations, and domestic violence risk assessments — are not available to the general public under Superintendence Rules 44–47 and ORC §§3105.171(E)(3) and 3109.04.

The Guernsey County Juvenile Court is a division of the Common Pleas Court located on the second floor of the Guernsey County Courthouse. Juvenile case files are among the most restricted categories of court records in Ohio. Records in abuse, neglect, and dependency proceedings are generally confidential, and the names of juveniles involved in those cases are withheld from public court documents. Access to juvenile records is generally limited to the juvenile, the juvenile’s attorney, and the juvenile’s parents or guardians, except where a court order provides broader access.

Marriage licenses in Guernsey County fall under the exclusive jurisdiction of the Probate Court rather than the Domestic Relations Division. Certified copies of marriage certificates are available from the Guernsey County Probate Court for a fee of $2.00 per copy. The Ohio Supreme Court also maintains standardized domestic relations and juvenile forms, which the Guernsey County Public Library makes available as a public resource.

The Guernsey County Probate Court operates as a specialized division of the Common Pleas Court and carries more than 200 separate statutory responsibilities under the Ohio Revised Code. The court’s jurisdiction extends to estate administration, wills, guardianships, conservatorships, adoptions, civil mental illness commitments, name changes, marriage licenses, testamentary trusts, and the appointment of various boards and commissions. Probate records are searchable through the court’s online record search, and the court maintains a Historical Records Index reaching back to 1812.

For estate proceedings, the court appoints a fiduciary — either an executor named in a will or an administrator designated by the court — who collects estate assets, satisfies outstanding debts, and distributes remaining assets to beneficiaries and heirs under court supervision. Bonds may be required, and the fiduciary must file an inventory and accounting with the court.

Guardianship proceedings require a hearing and investigation before the court will appoint a guardian for a minor or an incompetent adult. Adult wards retain the right to legal representation at all stages. Conservatorships are available for individuals who are mentally competent but physically infirm and who consent to the arrangement. Adoption proceedings must be approved by the Probate Court; applicants undergo an investigation of their home environment by trained personnel before adoption is finalized.

Birth records predating December 20, 1908, are available directly from the Probate Court. For births from December 20, 1908 onward, certified copies are obtained through the Ohio Department of Health Vital Statistics office or the Guernsey County Health Department at 326 Highland Ave, Cambridge, OH 43725, (740) 439-3577 ext. 252.
