How to Look Up a Court Case in Hamilton County?

Hamilton County’s judicial system includes the Court of Common Pleas (with General, Domestic Relations, Juvenile, and Probate divisions), the Hamilton County Municipal Court (with Civil and Criminal divisions), the First District Court of Appeals, and numerous Mayor’s Courts across incorporated municipalities. By Mail or Fax

Requesters can submit a completed Common Pleas Document Request Form by mail, fax, or in person. The request should include identifying case details such as the case number, filing date, and names of the parties involved.

Are Court Records Public in Hamilton County?

Under the Ohio Public Records Act (Ohio Revised Code § 149.43), records maintained by public offices—including courts—are presumed open to public inspection. Any person may request court records without stating a reason, and the custodian must provide access within a reasonable time.

However, several categories of court records are exempt from public disclosure or subject to restricted access:

  • Sealed records — Cases sealed by court order under Ohio Revised Code §§ 2953.31–2953.34 are removed from public search results. In Hamilton County, eligible individuals may apply for record sealing or expungement through the Clerk of Courts. The filing fee for conviction-based applications is $50 (non-refundable), while non-conviction sealings carry no fee. Misdemeanor applications are filed at the Justice Center (1000 Sycamore Street, Room 112), and felony applications at the Courthouse (1000 Main Street, Room 315).
  • Juvenile records — Most juvenile proceedings are confidential under Ohio law. Public records requests to the Hamilton County Juvenile Court should be directed by email to the court’s communications director.
  • Adoption records — Sealed by statute and accessible only under limited circumstances.

Background Checks Through the Sheriff’s Office

The Hamilton County Sheriff’s Office conducts criminal background checks at the Justice Center Records Division. These checks are available in person, with or without a scheduled appointment. Fees are as follows:

  • Local (Hamilton County only): $5
  • Statewide (BCI): $32
  • Nationwide (FBI): $36 (fingerprinting costs $10 per card)

Local checks are available Monday–Friday, 7:00 AM – 3:00 PM. Nationwide FBI checks are available 24 hours a day, 7 days a week.

Record Sealing and Expungement

Individuals with eligible criminal records may apply to have them sealed or expunged. The waiting periods depend on the severity of the offense. For felonies, the waiting period ranges from one year (4th or 5th degree) to three years (3rd degree) after final discharge. Misdemeanor convictions require a one-year wait, while minor misdemeanors require six months. Certain offenses—including domestic violence convictions, first and second degree felonies, some sex offenses, and OVI-related traffic violations—are not eligible. Hamilton County Civil Court Records

Civil cases in Hamilton County are heard by both the Court of Common Pleas (General Division), which has unlimited civil jurisdiction, and the Hamilton County Municipal Court (Civil Division), which handles disputes up to $15,000, including small claims and eviction proceedings.

Hamilton County Family Court Records

Family law matters in Hamilton County are handled by two separate court divisions. Most juvenile court records are confidential under Ohio law. Media and public records requests should be submitted to the Juvenile Court’s communications director. Parties involved in custody cases are required to complete the Positive Parenting Program (Triple P) before their first hearing.

Birth and Death Records

Historical birth records (1863–1908) and death records (1881–1908) are available online through the Hamilton County Probate Court’s Birth Records and Death Records archive pages. Hamilton County Probate Court Records

Searching Probate Records Online

The Probate Court maintains a comprehensive Case Search page where users can access indexes and docket images for most case types. The search covers estates, wills, trusts, guardianships, minister’s licenses, birth registrations, and corrections. Records Not Available Online

Two categories of Probate Court records are excluded from the public online search:

  1. Marriage licenses — While historical marriage indexes are available online, current license applications and certificates must be obtained in person.
