Are Court Records Public in Knox County?
Court records in Knox County are presumed open to public inspection under Ohio Rules of Superintendence, Rule 45(A) and Ohio Revised Code Section 149.43. These provisions establish that members of the public may visit a clerk’s office to inspect and copy court records that have not been restricted by statute or court order.
Certain categories of records are shielded from public disclosure, however. Sup. R. 44 and 45 require courts to protect specific types of information and restrict access to particular case files. The following records are generally exempt from public access in Knox County:
- Sealed and expunged records: Criminal and other case records that have been sealed or expunged by court order are removed from public view, including online search portals.
- Juvenile records: Case files involving minors adjudicated in Juvenile Court are confidential, as are records managed by the Ohio Department of Youth Services concerning detained minors.
- Adoption and certain custody records: Adoption proceedings and specific child custody materials are withheld from public disclosure.
- Victim-sensitive information: Records involving victims of sexual assault, stalking, or domestic abuse may be restricted.
- Medical and mental health records: Patient histories, medical reports, and records concerning mentally ill persons are exempt.
- DNA records: Test results and data stored in DNA databanks maintained for law enforcement purposes are not publicly accessible.
- Personal identifiers: Financial account numbers, Social Security numbers, credit card information, and similar private data must be redacted before records are released.
- Department of Rehabilitation and Correction records: Certain inmate records transferred to the Department of Youth Services are restricted.

Knox County Criminal Court Records
Criminal cases in Knox County are prosecuted in either the Common Pleas General Division (felonies) or the Mount Vernon Municipal Court (misdemeanors and traffic offenses). The Municipal Court also handles certain felony preliminary hearings before cases are bound over.

Criminal Expungements
Individuals seeking to seal or expunge a criminal record in Knox County file through the Clerk of Courts. The filing fee for expungement and post-conviction motions is $50.
Knox County Civil Court Records
Civil litigation in Knox County is split between the Common Pleas General Division and the Mount Vernon Municipal Court. The Municipal Court provides downloadable forms for eviction filings, small claims complaints, and other civil matters through its Civil Division page. Small claims hearings are scheduled within 40 days of filing, and the court handles claims for monetary damages only (not return of property).

Knox County Family Court Records
The Domestic Relations Division of the Knox County Court of Common Pleas has exclusive jurisdiction over divorces, dissolutions of marriage, legal separations, annulments, child custody and parenting time, child support, spousal support, and civil protection orders. Fees are paid at the Clerk of Courts office on the third floor of the courthouse. Parenting Education
Knox County requires both parties to complete a parenting seminar in all divorce and dissolution cases involving minor children. Information about the seminar is available on the Common Pleas Court website.
Civil Protection Orders
CPO petitions are filed through the Domestic Relations Division for domestic violence matters between family or household members and for stalking or sexually oriented offenses. Divorce Records
Divorce and dissolution records are maintained by the Clerk of Courts and accessible through the CourtView search portal. Users can filter by case type to locate specific dissolution or divorce proceedings. Copies of decrees and other filings can be obtained from the Clerk’s office. Marriage Records
Marriage licenses in Knox County are issued exclusively by the Probate Court. The application fee is $60, payable by cash, check, or credit card (a $3.95 convenience fee applies for card payments). Both applicants must appear together with valid identification. If either party was previously married, a certified copy of the most recent divorce or dissolution decree is required. No blood tests or witnesses are needed, and there is no mandatory waiting period — the license is valid upon issuance and must be used within 60 days. Certified copies of returned marriage licenses cost $3 each and can be requested in person, by phone, email, or mail. The Probate Court’s online records search allows public access to marriage license records.
Birth and Death Records
Birth and death certificates are maintained by the Knox County Health Department, not by the courts. Certified copies cost $25 each and can be ordered in person or by mail using the department’s application form. Eligible requesters include the record subject, parents, spouses, siblings, children, guardians, or legal representatives. Acceptable payment includes cash, credit/debit cards, checks, and money orders payable to Knox Public Health.

Knox County Probate Court Records
The Knox County Probate/Juvenile Court is a division of the Court of Common Pleas located at 111 East High Street, Mount Vernon, OH 43050. The Probate Division has jurisdiction over the administration of decedents’ estates, probate of wills, guardianship and conservatorship appointments, adoption proceedings, name changes, involuntary commitments of mentally ill persons, and the issuance of marriage licenses. The court also handles trust matters and birth registration corrections.
Estate Administration
When a Knox County resident dies, the Probate Court supervises the administration of their estate, whether testate (with a will) or intestate (without a will). The court appoints personal representatives, resolves disputes among heirs and beneficiaries, and approves the distribution of assets. All transactions within an estate administration are subject to the court’s examination and approval.
Guardianships and Conservatorships
The Probate Court appoints guardians for incapacitated adults and minors, and conservators to manage the financial affairs of protected persons. Ongoing court oversight applies throughout the duration of any guardianship or conservatorship.
Adoptions and Name Changes
Adoption proceedings are filed and heard in the Probate/Juvenile Division. These records are confidential and not available through public search tools. Name change petitions are also filed in Probate Court and, once granted, are part of the public record.
