Written Public Records Request

Are Court Records Public in Portage County?

Court records in Portage County are presumed open to the public. This presumption rests on two overlapping legal frameworks.

The first is the Ohio Public Records Act, codified at Section 149.43 of the Ohio Revised Code. The Act defines “public records” broadly as any document maintained by a public office, regardless of physical form, and requires that such records be available for inspection and copying. The Ohio Attorney General’s Public Records Act overview confirms that “any person” may request records without having to state a purpose.

The second framework is the Ohio Rules of Superintendence for the Courts of Ohio, specifically Rules 44 through 47. Rule 45(A) states plainly that “court records are presumed open to public access”. Rule 45(B) requires courts and clerks to make records available promptly and allows them to charge only their actual costs for duplication. Rule 45© permits but does not mandate remote (electronic) access and provides that the online version of a record must be identical to the version available in the clerk’s office.

Despite the strong presumption of openness, certain categories of records or information are exempt or restricted:

  • Personal identifiers: Social Security numbers (except last four digits), financial account numbers, and employer/employee identification numbers must be omitted from filings under Rule 45(D).
  • Juvenile records: Abuse, neglect, and dependency case records, juvenile civil commitment files, post-adjudicatory residential treatment facility reports, and juvenile social histories are excluded from the definition of “case document” under Rule 44©(2)(d).
  • Adoption proceedings: Adoption files are sealed by operation of Ohio law and are not available for public inspection.
  • Records restricted by court order: Under Rule 45(E), any party or affected person may move to restrict public access to specific information or entire documents. The court must find by clear and convincing evidence that the higher interest outweighs the public access presumption and must use the least restrictive means available, such as redaction rather than full sealing.
  • Active investigations and trial preparation materials: Records whose release could jeopardize an ongoing investigation or compromise trial preparation may be withheld.
  • Medical records, trade secrets, and certain personal information of peace officers, firefighters, and EMTs are also exempt under state law.

Anyone denied access to a court record may pursue a mandamus action under Ohio Revised Code Chapter 2731, as provided in Rule 47(B).

Portage County Criminal Court Records

Searching Criminal Court Records Online

The CourtView portal indexes criminal cases from 1992 onward. Portage County Family Court Records

Family law matters in Portage County are adjudicated by the Portage County Domestic Relations Court, a division of the Court of Common Pleas. Proceedings in this court are governed by the Domestic Relations Rules of Court.

Confidentiality Restrictions

Certain family court records carry access restrictions. Divorce affidavits filed in Portage County are not open for public viewing. Personal information within case files—such as children’s names, dates of birth, and financial account numbers—is routinely redacted. Sealed records and records involving juveniles are accessible only to parties to the case, their attorneys, and specifically authorized entities.

Marriage Records

Portage County Probate Court Records

In-person requests can be directed to the Probate Court clerk window at 203 W. Main Street during regular hours. The Probate Court cost schedule lists filing fees organized by case type. Common ongoing probate filing fees are $150.00 under R.C. 2101.16 for general matters, plus a $20.00 Probate Court Special Projects Fund fee on all filings except marriage licenses. The distribution report filing fee is $7.00. All fee figures should be verified with the court, as they are subject to legislative and administrative changes.

Adoption and Guardianship Records

Adoption records are sealed under Ohio law and are not available for public inspection. Guardianship records, on the other hand, are generally accessible to the public through the same CourtView portal or by request at the Probate Court. Guardianship filings include appointment of guardians for minors and incompetent adults, annual reports, and accountings. Any party seeking access to a sealed adoption file must obtain a court order.
