Tuscarawas County sits in east-central Ohio, with its county seat in New Philadelphia. The county's judicial system includes the Court of Common Pleas (with General, Juvenile, and Probate divisions), the New Philadelphia Municipal Court, the Tuscarawas County Court Southern District, and two Mayors Courts. The Clerk of Courts and the Probate Court each maintain separate sets of records, so it's worth knowing which office holds what you need before submitting a request.

OhioCourts.us can also help identify statewide court resources and locate publicly available case information for Tuscarawas County and other Ohio jurisdictions.

Are Court Records Public in Tuscarawas County?
Ohio law creates a strong presumption that government records are open to the public. Ohio Revised Code 149.43 defines public records broadly and requires that they be made available promptly upon request. Court filings, docket entries, judgments, and most case documents maintained by the Clerk of Courts and the various court divisions fall within this definition.
That said, several categories of records are exempt from public disclosure. Restricted or confidential records in Tuscarawas County include:
- Sealed and expunged criminal records — Cases sealed by court order under R.C. 2953.32 or expunged under R.C. 2953.31 et seq. are removed from public view.
- Juvenile court records — Files from Juvenile Division proceedings are confidential under R.C. 2151.14 and may only be inspected by parties, their attorneys, or individuals granted access by the court.
- Grand jury proceedings — Testimony and evidence presented to a grand jury remain secret under Criminal Rule 6.
- Adoption records — Sealed upon finalization under R.C. 3107.17.
- Domestic violence victim information — Addresses and identifying details of victims may be redacted or restricted under applicable statutes and court rules.
- Active law enforcement investigatory records — Certain investigatory work products are exempt under R.C. 149.43(A)(2).
- Trade secrets and confidential business information — Protected when filed under seal by court order.
If you believe you've been improperly denied access to a public record, you may file a mandamus action under R.C. 149.43 or contact the Ohio Court of Claims Public Records Unit.
